This Membership Agreement ("Agreement") is entered into between Oliver Athletics ("the Club") and the Member identified in the profile
MEMBERSHIP TERMS
The Member agrees to abide by all Club policies, procedures, membership rules, facility regulations, and staff instructions while utilizing Oliver Athletics facilities and services.
Membership privileges are non-transferable and may only be used by the Member listed on this Agreement.
The Club reserves the right to modify operating hours, class schedules, equipment availability, staffing levels, and facility amenities at its discretion.
BILLING AUTHORIZATION
The Member authorizes Oliver Athletics to process recurring membership payments using the payment method provided.
The Member is responsible for ensuring payment information remains current and valid.
Returned payments, failed payments, declined transactions, or chargebacks may result in suspension of membership privileges and may be subject to administrative fees.
Any outstanding balances remain the responsibility of the Member.
CANCELLATION POLICY
The Member acknowledges and agrees that:

Membership cancellation requires a minimum of thirty (30) days written notice.

Notice must be submitted using the Club's Membership Cancellation Request Form.

The thirty-day notice period begins on the date the completed cancellation form is received by Oliver Athletics.

Membership dues remain payable throughout the notice period.

Because memberships are billed biweekly, the Member understands and agrees that two additional biweekly payments will generally be processed following submission of a cancellation request.

Membership access and privileges remain active throughout the notice period provided the account remains in good standing.

Verbal requests, social media messages, text messages, or verbal conversations with staff do not constitute formal notice of cancellation.

Membership fees are non-refundable except where required by law.

24-HOUR ACCESS POLICY
Members granted 24-hour access acknowledge and agree that:
• Facility staff may not be present during all access hours.
• Members use the facility at their own risk during staffed and unstaffed hours.
• Access credentials, key fobs, access cards, entry codes, or mobile credentials may not be shared with any other individual.
• Allowing unauthorized access to non-members may result in immediate membership termination.
• Members may be financially responsible for damages resulting from unauthorized access granted by them.

VIDEO SURVEILLANCE
For the safety and security of members, staff, and property, the facility may utilize video surveillance systems.
The Member acknowledges that activities within the facility may be recorded and monitored.

CODE OF CONDUCT
All Members agree to follow the Club Code of Conduct:

Cleanliness: Members must wipe down equipment after use with provided disinfectant wipes.

Proper Attire: Athletic clothing and supportive footwear are required at all times.

No Food: Eating is not allowed in workout areas. Only water bottles are permitted.

Equipment Use: Limit workouts to 60 minutes during peak hours to ensure access for all members.

Return Weights: Always return weights and equipment to their designated storage areas.

Sharing Equipment: Be considerate and allow others to work in during rest periods when appropriate.

Noise Levels: Keep noise and mobile phone conversations to a reasonable level.

Personal Hygiene: Maintain personal hygiene and cleanliness while using the facility.

Report Issues: Immediately report broken equipment, safety concerns, or hazards to staff.

Age Restrictions: Members must be at least fourteen (14) years old unless accompanied by a parent, guardian, or authorized coach/trainer.

Respect Others: Treat fellow members, guests, coaches, and staff with respect. Harassment, discrimination, intimidation, abusive language, or inappropriate conduct will not be tolerated.

Limit Guests: Guests are permitted only in accordance with current Club guest policies.

Emergency Procedures: Members are responsible for familiarizing themselves with facility emergency exits and procedures.

Personal Items: Secure personal belongings appropriately. Oliver Athletics is not responsible for lost, stolen, or damaged property.

No Smoking: Smoking, vaping, and tobacco use are prohibited within the facility and on Club property.

Equipment Misuse: Equipment must only be used for its intended purpose and in a safe manner.

Illegal Substances: The possession, use, or distribution of illegal drugs is strictly prohibited.

Recording Others: Members may not photograph or record other members without their consent.
Violation of the Code of Conduct may result in warnings, suspension, termination of membership, or revocation of facility access without refund.

SUSPENSION AND TERMINATION OF MEMBERSHIP
Oliver Athletics is committed to providing a safe, respectful, and welcoming environment for all members, guests, coaches, staff, and visitors.
Oliver Athletics reserves the right, at its sole discretion, to suspend, revoke, or immediately terminate a membership, facility access privileges, or participation in any program without refund if a Member engages in conduct that the Club determines is unsafe, inappropriate, disruptive, unlawful, or contrary to the interests of the Club, its members, or staff.
Grounds for immediate suspension or termination may include, but are not limited to:

Sharing access credentials, key fobs, entry codes, membership cards, mobile access credentials, or any other means of facility entry with another individual.

Permitting unauthorized individuals to enter the facility, including "tailgating" or allowing a non-member to enter using the Member's access privileges.

Theft, attempted theft, fraud, or intentional damage to Club property, equipment, facilities, or the property of other members.
-
Violence, threats of violence, intimidation, aggressive conduct, fighting, or behavior that causes another person to fear for their safety.
-
Harassment, discrimination, bullying, stalking, unwanted advances, inappropriate comments, or any conduct that creates a hostile or uncomfortable environment for others.
-
Inappropriate, indecent, offensive, disruptive, or sexually explicit conduct anywhere within the facility, including workout areas, change rooms, washrooms, showers, hallways, entrances, parking areas, or surrounding property.

Recording, photographing, or distributing images or video of members, guests, or staff without their knowledge or consent where privacy would reasonably be expected.

Possession, use, distribution, or being under the influence of illegal drugs or controlled substances while on Club property.

Repeated violations of Club policies, facility rules, staff instructions, or the Code of Conduct.
-
Misuse of equipment, unsafe training practices, or conduct that places the Member or others at risk of injury.
-
Providing false information during membership registration or misrepresenting eligibility for membership discounts or special pricing programs.
-
Any criminal activity occurring on Club property.
The Club reserves the right to investigate incidents and make final determinations regarding violations of Club policies.
The Member acknowledges and agrees that Oliver Athletics may immediately deactivate access privileges and terminate membership without advance notice where the Club reasonably believes such action is necessary to protect the safety, security, property, reputation, or operation of the facility.
In cases involving serious misconduct, including but not limited to unauthorized access, theft, violence, harassment, vandalism, or inappropriate conduct, membership may be terminated immediately and without refund of membership fees, prepaid dues, initiation fees, or other amounts paid.
The Member agrees that decisions regarding suspension or termination made under this section shall be final and binding, subject only to any rights that may be provided under applicable law.
